This English version is a translation provided for convenience. If there is any difference between this version and the Japanese version, the Japanese version prevails.

These Terms of Use ("these Terms") set out the conditions for using Wayviy (wayviy.com; "the Service"), a service operated by YAMI Inc. ("we", "us"). These Terms apply to your use of the Service. For how we handle information about users, please see our Privacy Policy.

1Definitions

In these Terms, the following words have the meanings below.

2Accounts

  1. An account is created when you log in with a Google, X, or Apple account and complete the Service's registration process.
  2. You are responsible for managing the outside account you use to log in. We are not liable for any damage caused by a third party's use of that account, unless we acted intentionally or with gross negligence.
  3. You must not impersonate another person or use another person's account.
  4. We may suspend an account that violates these Terms (Section 8). You must not create another account to get around a suspension.
  5. Because we do not collect an email address for login, if you can no longer use the Google, X, or Apple account you used to log in, we may be unable to recover your account on the Service. We recommend registering more than one login method from the Settings screen.

3Age

  1. Only people 16 or older may create an account. People under 16 may use the Service without creating an account.
  2. You must answer accurately about your age when you create an account.
  3. Members under 18 cannot use some features. Only Members 18 or older may create, Remake, or publish Quests.
  4. If you are under 18, you must get your parent or guardian's consent before you create an account.
  5. If you are under 18, please read these Terms together with your parent or guardian.
  6. If we determine that a person under 16 holds an account, we may suspend that account.

4What the Service Offers and Changes to It

  1. We may change what the Service offers, or suspend or end the Service, without notifying you in advance. Where possible, we will announce important changes in the app in advance.
  2. The Service may be unavailable because of equipment maintenance or failure, network outages, disasters, or other causes.
  3. The Service is currently free of charge. If we offer paid features, we will show their fees and conditions in advance.
  4. Ads from us or third parties may be shown in the Service. How information is handled when ads are shown is described in our Privacy Policy.

5Rights in Quests and Posts

  1. Our rights: Rights in the Materials, the Quests we provide, and the systems of the Service (including the systems that run and create Quests) belong to us or their rightful owners.
  2. Your rights: You keep the rights you already hold in the parts you create yourself (prompts, titles, descriptions, comments, profile, and so on). We make no guarantee as to whether any rights arise in the parts generated by AI (programs, concepts, explanations, and so on), or as to whom any such rights belong. Subject to these Terms, you may use and publish Quests you create within the Service.
  3. License to Quests you create: For as long as a Quest you create is offered on the Service, you grant us a free, worldwide license to use it (including storing, copying, displaying, and distributing it, and modifying it to fit display formats) to distribute and display it within the Service, to create demo videos, explanations, and thumbnails, and to promote the Service (including promotion outside the Service). After a Quest you create or your account is deleted, we will stop distributing that Quest. However, promotional materials made before the deletion, and Remakes under the next paragraph, may continue to be used after the deletion without any time limit.
  4. Permission to Remake: As the creator of a Quest you create, you can choose for each Quest whether to allow other users to Remake it (the default is "allow"). For a Quest you create that is set to allow Remakes, you permit other users to create a Remake based on that Quest within the Service and to publish it. If you later change the setting to not allow Remakes, Remakes that have already been created will not be deleted. We display within the Service the name of the creator of the Quest on which a Remake is based. However, if that creator has deleted their account, or if their name otherwise cannot be shown, it is shown as "an unknown creator".
  5. Use of public posts: You grant us permission to use your public posts to display and distribute them within the Service and to check whether they comply with these Terms. When a public post is deleted, we stop displaying it (we may keep its content for safety and legal purposes; see Privacy Policy Section 8).
  6. Use of Submissions: We use Submissions only as needed to handle them, keep the Service safe, and respond to legal matters. For a rights violation report, we may tell the user who is the subject of the report what the report says (what it concerns, the type of right, and the reason for the report). We will not share the reporter's contact details without the reporter's consent.
  7. You agree not to exercise moral rights against us with respect to our use under paragraphs 3 and 5, or against us and the user making the Remake with respect to Remakes under paragraph 4.
  8. Scope of use: Quests are for playing within the Service. Unless we separately permit it, you may not take Quests or Materials outside the Service to use, distribute, or sell them. We do not currently offer a feature to export Quests.
  9. You must have the rights needed for the content you enter or provide, and you must not intentionally enter or publish content that infringes the rights of third parties (copyright, trademark rights, portrait rights, privacy, and so on).
  10. If you believe your rights have been infringed, please let us know through "Report a rights violation" in the app (you can report without an account).

6Creating with AI

  1. When you create a Quest, we send your prompt and other input to outside AI providers (Privacy Policy Section 4). Do not enter personal or confidential information in your prompts.
  2. Content generated by AI may differ from what you intended, contain errors, or resemble other works. You must play and check the content yourself before publishing it.
  3. We do not use prompts, Quests you create, or other posts to train AI models (Privacy Policy Section 2).
  4. We check prompts and Quests you create with automated systems, and have people check them when needed. Content that does not comply with these Terms may not be able to be created or published.
  5. Creating a Quest may use Coins (Section 9). If creation fails, we will return the Coins according to our rules.

7Prohibited Conduct

When using the Service, you must not do any of the following. This applies to Quests you create, prompts, and public posts alike.

  1. Sexual content, or content that sexualizes children
  2. Content that promotes severe violence, threats, self-harm, or harm to others
  3. Harassment, discrimination or hate, or content that demeans real people
  4. Grooming targeting children, or inappropriate contact with minors
  5. Posting contact information (social media or messaging app IDs, phone numbers, email addresses, addresses, schools, and so on) anywhere other than the profile's external link field that we provide, and inviting others to communicate outside the Service
  6. Fraud, spam, mass posting for advertising, or impersonation
  7. Content that promotes illegal activity, gambling, drugs, or dangerous challenges
  8. Infringing the rights of third parties (copyright, trademark rights, portrait rights, privacy, and so on)
  9. Exploiting bugs to manipulate scores or rankings, or to obtain Coins improperly
  10. Embedding programs that harm the Service or other users' devices, attempting to get around the systems that isolate Quests, or putting excessive load on the Service
  11. Collecting large amounts of information from the Service by automated means without our permission
  12. Collecting other users' personal information
  13. Providing benefits, directly or indirectly, to antisocial forces (such as organized crime groups)
  14. Creating an account if you are under 16, or lying about your age
  15. Any other conduct that violates laws or public order and morals, or that we determine to be inappropriate

8Actions We May Take

  1. If we determine that you have violated these Terms, or that you are likely to do so, we may, without prior notice, hide or delete Quests you create or public posts, stop distributing Quests, restrict features, or suspend your account.
  2. We may check, using automated systems and other methods, whether Quests you create and public posts comply with these Terms.
  3. We check content when we receive reports from users or others. We do not suspend an account based only on the number of reports or only on automated decisions. We never disclose who made a report to the user who is the subject of the report.
  4. If you disagree with an action, please contact us through the contact form, choosing the type "Something restricted or removed".
  5. For safety reasons, we may not disclose the detailed reasons for an action.
  6. We may provide information to the police or other organizations when someone's life or physical safety is at risk, or when doing so is based on laws or regulations.

9Coins

  1. Coins can be used within the Service to create Quests and for other purposes. In addition to Coins we give out free of charge, Coins may be purchased in the ways we specify. The terms of purchase (price, payment method, expiry and so on) are shown on the purchase screen and in the Notation under the Specified Commercial Transactions Act.
  2. Each Coin has an expiration date, and Coins expire once that date has passed. Expiration dates are shown in the Service.
  3. Coins cannot be exchanged for money or anything else, transferred to other users, or bought or sold.
  4. If you delete your account, any remaining Coins are lost. You cannot use Coins while your account is suspended.
  5. When you use Coins to create a Quest or for similar purposes, the Coins are consumed by the AI carrying out the creation. We do not guarantee the content or quality of the Quest created (for example, that it is fun or exactly as you asked). If the creation cannot be completed for reasons on our side, such as not passing our automated checks or not finishing in time, we will return the Coins used.
  6. We may change how many Coins we give out, how we give them out, and what they can be used for.

10Third-Party Services

The Service uses Google, X, and Apple services for login. Your use of those services is subject to each company's terms. The Service may be unavailable because of outages or other problems with those companies' services.

11Disclaimers and Limitation of Liability

  1. We do not guarantee that the Service is free of errors, bugs, or interruptions, or that it is fit for any particular purpose.
  2. Except where we are responsible, disputes between users, or between a user and a third party, are to be resolved between the parties involved. We may cooperate if we consider it necessary.
  3. If we cause you damage in connection with the Service, our liability is limited to direct damage that would ordinarily arise, unless we acted intentionally or with gross negligence.
  4. The preceding paragraphs do not apply to the extent that the Consumer Contract Act of Japan or other laws do not allow our liability to be excluded or limited.

12Deleting Your Account

  1. Members can delete their account at any time from the app's Settings screen.
  2. What information is erased and what is kept when you delete your account is set out in Privacy Policy Section 8. Quests you create and comments will be hidden, but we may keep their content for safety and legal purposes.
  3. A deleted account cannot be restored.

13Changes to These Terms

We may change these Terms in accordance with the law if the change is in the general interest of users, or if the change is reasonable in light of the need for it, the appropriateness of the new content, and other circumstances. If we change these Terms, we will announce on this page and in the app, before the effective date, that we are changing them, what the new content is, and the effective date.

14Governing Law and Jurisdiction

These Terms are governed by and interpreted in accordance with the laws of Japan. The Tokyo District Court has exclusive agreed jurisdiction as the court of first instance over any dispute relating to the Service.
